Terms of Service

These Terms of Service are between Irene Teresa Photography (“Photographer”) and [You] (“Client”). 

“Image(s)” are the photographic material that has been created by Photographer to include all still and moving images produced at time of session to include all digital files that were captured and stored on any device.

USAGE RIGHTS/OWNERSHIP

Client acknowledges that Photographer is the Author of the Image(s) and therefore the first and sole owner of all copyrights of the Image(s). The Image(s) and all copyrights remain the exclusive property of Photographer without limitation. 

Photographer will supply Client with Print Release at time of final image delivery.

PHOTOGRAPHIC ALTERATIONS

Client shall not make or permit to be made any alterations to any and all images supplied by Photographer, including, but not limited to, filters, additions, subtractions, or adaptations, without the prior written permission of Photographer. 

Portrait sessions include editing that may consist of color change, crop, contrast, exposure and any retouching at the discretion of Photographer.

IMAGE LICENSING

Copyright metadata contained within any and all digital files supplied by Photographer may not be altered, or removed, without the written consent of Photographer.

Photographer retains the right to use the Image(s) for self-promotion. 

RECOGNITION AND COPYRIGHT

Any and all images posted to the internet, to include all social media platforms, must include recognition of Photographer or include a copyright notice.

GENERAL LIABILITY AND RELEASES:

Photographer shalll not be liable for any loss, damages, or costs, incurred by Client, or by any other party, arising from, or in any way related to, Client’s use of any Image(s).

Client shall indemnify, defend, and hold harmless, Photographer, and any subcontractors, employees or other representatives of Photographer, against any and all claims, liabilities, damages, costs, and expenses, including, but not limited to, reasonable legal fees and expenses, that may arise from Client’s use of any Image(s).

ARCHIVAL OF DIGITAL FILES:

Photographer will archive any Image(s) supplied to Client for a period of three months. It is Client’s responsibility to properly store and archive any images supplied by Photographer. Photographer cannot guarantee the availability of any Image(s) beyond the three month archival period.
